1. Eligibility

EveryDay Strong with Amy provides fitness, exercise, wellness, nutrition, and personal training content for informational and educational purposes only. We are not a medical provider, and our Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Before beginning any exercise, nutrition, or wellness program, you should consult with your physician or another qualified healthcare professional, especially if you have any pre-existing medical conditions, injuries, or concerns.

By participating in any exercise or fitness activities provided through our Services, you acknowledge and agree that:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYDAY STRONG WITH AMY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • FITNESS FOR A PARTICULAR PURPOSE;
  • NON-INFRINGEMENT;
  • ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICES.

We do not guarantee uninterrupted access, error-free operation, or specific fitness or health outcomes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYDAY STRONG WITH AMY, ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • PERSONAL INJURY;
  • LOSS OF PROFITS;
  • LOSS OF DATA;
  • BUSINESS INTERRUPTION;
  • EMOTIONAL DISTRESS;
  • HEALTH-RELATED CLAIMS ARISING FROM USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless EveryDay Strong with Amy and its affiliates, owners, employees, contractors, and partners from and against any claims, damages, liabilities, losses, costs, or expenses arising out of:
